Mother jailed over Starship child abuse diagnosis wins fresh appeal after new evidence emerges

Summarised by Centrist

A mother imprisoned for allegedly abusing her infant daughter will have her conviction reconsidered by the Court of Appeal after independent international medical experts challenged the evidence used to convict her.

The case raises questions about child abuse diagnoses at Auckland's Starship Hospital.

The Criminal Cases Review Commission has referred the case following a nearly three-year investigation by Newsroom journalists Melanie Reid and her team.

Acting Chief Commissioner Paula Rose said there was now "significant expert evidence" unavailable to the original jury that challenged the medical findings relied upon at trial.

The mother, identified as Zita, was convicted after four Starship doctors testified that her eight-week-old baby's injuries were deliberately inflicted, a diagnosis known as abusive head trauma.

No independent medical experts testified for her defence. She was sentenced to two years and seven months in prison, while her daughter was placed in four different foster homes. The family also faced possible deportation.

Newsroom obtained the child's medical records and scans, commissioning specialists from Canada, Norway, the Netherlands and the United States to review them.

The experts concluded the injuries were more likely related to a traumatic birth and severe vitamin D deficiency than deliberate abuse.

Their findings helped persuade the commission to reopen the case, making it only the eighth referral among 706 applications received since 2020.

The investigation has also identified other families whose children were removed or whose parents faced prosecution following disputed Starship diagnoses.

In one case, international specialists challenged the existence of fractures identified by New Zealand doctors. In another, a father was acquitted after independent medical evidence challenged the prosecution's explanation for his baby's injuries.

Health NZ maintains confidence in the expertise and integrity of its child protection specialists and says it cannot comment on individual cases.

Zita and her daughter were reunited in April 2025 after years apart.
